1. Scope of Application, Obligations, and Costs
These terms and conditions apply when individuals participate in contests and tenders organized by

(hereinafter referred to as "the Organizer") https://hochbeet.com/. Participation is free of charge and voluntary, and without obligation for participants. Legal recourse is excluded.
2. Eligibility to Participate
Residents with permanent residency in Austria, Germany, or Switzerland are eligible to participate in contests and tenders on https://www.facebook.com/Hochbeetcom. A person may only participate once per contest. Automated entries will be excluded from participation. The Organizer reserves the right to request proof from participants that they meet the above-mentioned requirements. If proof is not provided upon request, the participant may be excluded from the promotion by the Organizer. Furthermore, the Organizer reserves the right to immediately exclude participants who violate criminal laws, good morals, or these terms of play from participation.
3. Rights of Third Parties
Participants declare that their submission to the contest (e.g., texts, drawings, or photographs) does not infringe upon the rights of third parties, particularly copyrights and personal rights.
If other persons were involved in the creation or development of the entry, they must agree to its submission and subsequent publication as part of the contest. The same applies if third parties have been granted an exclusive right to the submitted contributions. Even if other persons are recognizable in submitted photographs or drawings, their consent to the submission and subsequent publication must be obtained.
4. Processing
It is not possible to pay out the prize in cash, in kind, or to exchange or transfer it to other persons. For prizes in the form of a voucher, the payment of the prize, the sale, and the transfer of the voucher are not permitted.
Notification of winning will be sent by email or Facebook message within 14 days after the participation deadline of the promotion. The Organizer reserves the right to publish the winner on https://www.facebook.com/Hochbeetcom.
If the winner does not respond within 14 days, the Organizer reserves the right to determine a new winner. If the provided contact options are incorrect (e.g., postal or email addresses), the Organizer is not obliged to find correct addresses. The disadvantages resulting from the provision of incorrect contact details (e.g., incorrect postal or email address) shall be borne by the participant.
If it is discovered upon delivery that prizes are faulty or damaged, the Organizer must be notified within seven days of the delivery date, otherwise the prize will be deemed accepted as delivered. This does not affect the winners' statutory rights.
For participation via Facebook, the winner will be notified by the Organizer, and the winner must contact the Organizer within 48 hours to claim their prize. If the winner does not claim their prize within 48 hours, the Organizer reserves the right to forfeit the prize.
Facebook itself has no connection with the contest and is therefore excluded from any liability.
5. Data Protection Information for the Contest
The data entered by participants for participation in the contest will only be used for the processing and handling of the contest and will not be passed on to third parties – apart from the publication mentioned above.
The participant agrees that their submissions to the contest as well as the transmitted personal data (first name, last name, location, photograph or other electronic materials) in connection with the contest, its draw, and the processing thereof will be published on https://www.facebook.com/Hochbeetcom and the website https://hochbeet.com/.
Contest exclusively for newsletter subscribers: Only active newsletter recipients who have also fulfilled the required double opt-in confirmation for receiving the newsletter are eligible to participate in our contests.
The participant may revoke the publication of their personal data already during participation or retrospectively.
6. Changes to the Rules of Participation and Termination of the Contest
The Organizer reserves the right to change the terms and conditions at any time. Any such change must be announced immediately. Furthermore, the Organizer reserves the right to terminate or interrupt the contest or draw at any time for important reasons without prior notice. This applies in particular to reasons that would disrupt or prevent the scheduled course of the contest or draw.
7. Additional Conditions
Further terms and conditions (e.g., type and duration of the contest, type and scope of the prize) will be specified in the respective contest.
Should individual provisions of the terms and conditions be or become invalid, the validity of the remaining terms and conditions shall remain unaffected. An appropriate regulation that most closely corresponds to the purpose of the ineffective provision shall take its place.
